Overview

These are combined visa applications (temporary subclass 820 and permanent subclass 801) which are processed in two stages. For the partner visa application to be valid, both the temporary and permanent partner visa applications must be made at the same time.

You must be in Australia at the time of temporary partner visa lodgement and grant.

You must be in Australia at the time of permanent partner visa lodgement.

About this Visa

After the grant of Temporary partner (subclass 820) visa:

  • You can live, study and work in Australia while your permanent partner visa application (subclass 801) is being processed.
  • You can travel to and from Australia multiple times.
  • Access Australia’s public health care scheme, Medicare.

After the grant of Permanent partner (subclass 801) visa:

  • You can continue to live, study and work in Australia permanently.
  • If eligible, apply for Australian citizenship.
  • Sponsor your family members to come to Australia.
  • Access Australia’s public health care scheme, Medicare.
  • Access certain Australian Government payments and benefits.

 

Eligibility

Applicant Eligibility (subclass 820)

  • Must have a sponsor who is usually your partner.
  • Your sponsor partner must be either an Australian citizen or permanent resident or Eligible New Zealand Citizen.
  • Must be in Australia at the time of visa lodgement.
  • Must be aged 18 years or over at the time of visa application.
  • Must meet relationship requirements. This includes having a mutual commitment with your partner. For de facto partners, they must be in relationship for at least 12 months before visa application. The relationship must be genuine and continuing. You and your partner must be living together or not living permanently apart and must not be related by family.
  • Must meet Australian health and character requirements.

Applicant Eligibility (subclass 801)

  • Must continue to meet the relationship requirements. In certain cases where your relationship has broken down or your partner has died, you might still be eligible for this visa.
  • Must hold subclass 820 visa and at least 2 years must have passed since you made your combined partner visa application.

Sponsor Eligibility (subclass 820 and 801)

  • Must be either an Australian citizen or permanent resident or Eligible New Zealand Citizen.
  • Must be aged 18 years or over.
  • Must not have any sponsorship limitations.
  • Meet character requirements.
  • The sponsorship must be approved by Department of Home Affairs.
