Onshore Orphan Relative visa

(Subclass 837)

Overview

This is a permanent visa which lets the child stay in Australia indefinitely. The child must be single and already in Australia staying with a relative and their parents are deceased, can’t care for them or can’t be found.The child must be in Australia at the time of visa lodgement and grant. If the child is in Australia on another visa which has a no further stay condition imposed then the child can’t apply for this visa until the imposing condition is waived.

After the grant of Orphan Relative visa (Subclass 837):

  • The child can live, study and work in Australia permanently.
  • The child can travel to and from Australia multiple times.
  • The child can access Australia’s public health care scheme, Medicare.
  • If eligible, the child can apply for Australian citizenship.

Eligibility

Applicant Eligibility (subclass 837)

  • The child must have no parent who can care for them. Both the parents must either be deceased or permanently incapable of caring or can’t be found.
  • The child must be sponsored by an eligible sibling or step-sibling, grandparent or step-grandparent, aunt, uncle, step-aunt or step-uncle.
  • The child must be in Australia at the time of visa lodgement and grant.
  • The child must hold a substantive visa at the time of visa application.
  • At the time of application of this visa, the child must be under 18 years of age.
  • The child must have appropriate written consent to migrate to Australia.
  • Must meet Australian health and character requirements.

Sponsor Eligibility (subclass 837)

  • Must be either a settled Australian citizen or permanent resident or Eligible New Zealand Citizen.
  • Must be child’s eligible sibling or step-sibling, grandparent or step-grandparent, aunt, uncle, step-aunt or step-uncle.
  • Must be aged 18 years or over.
  • The sponsorship must be approved by Department of Home Affairs.
