Overview

The subclass 804 visa is an on-shore permanent visa that lets an aged parent of a settled Australian citizen, Australian permanent resident or eligible New Zealand citizen stay in Australia. Due to capping an applicant in the queue for a subclass 804 visa can expect to wait decades for the visa to be granted. Applicant must apply from within Australia and will be eligible for a bridging visa to stay in Australia while their visa application is being processed.

After the grant of Non-Contributory Aged Parent (Permanent) Visa (Subclass 804):

  • You can live, study and work in Australia permanently.
  • You can travel to and from Australia multiple times.
  • You can access Australia’s public health care scheme, Medicare.
  • You can sponsor eligible family members to come to Australia.
  • You can apply for Australian citizenship, if eligible.

Eligibility

Applicant Eligibility (subclass 804)

  • You must be old enough to receive age pension in Australia which is currently between 66 and 67 years of age, depending on your date of birth.
  • You must not have applied for or hold a Sponsored Parent (Temporary) (subclass 870) visa.
  • You must be sponsored by an eligible child.
  • You must meet balance-of-family (BOF) test. You will meet the BOF test if:
    • the number of eligible children is greater than or equal to the number of ineligible children; or
    • the greatest number of ineligible children usually resident in a particular overseas country is less than the number of eligible children.
    • An eligible child is a child who is an Australian citizen (regardless of where they live), or an Australian permanent resident or Eligible New Zealand Citizen who is usually resident in Australia.
    • The BOF test includes all the children of both parents including children from previous marriages or other relationships, even if they have never lived with the parent. It excludes children who were removed by court order (such as adoption), or who are residing in a country where there is persecution or an abuse of human rights or in a refugee camp.
  • You must have an Assurance of Support which is an undertaking that you will not rely on government assistance after you enter Australia on this visa.
  • You must meet Australian health and character requirements.

Sponsor Eligibility (subclass 804)

  • Sponsor is usually your child, aged 18 years or over.
  • Sponsor must be either a settled and Australian citizen or permanent resident or Eligible New Zealand Citizen.
  • The sponsorship must be approved by Department of Home Affairs.
